KOFM’S FOOTY TIPPING CONTEST RULES
The following Terms and Conditions apply to “KOFM’s Footy Tipping” promotion to be run on 102.9 KOFM in Newcastle.
These Terms and Conditions apply in conjunction with KOFM’s General Contest Rules. Where there is any inconsistency, these terms and conditions will prevail.
These terms and conditions can be collected at the KOFM reception desk at 252 Pacific Highway, Charlestown and can be downloaded from the website at http://www.kofm.com.au

ENTRY

1. KOFM’s announcers will solicit for listeners to register to participate in Footy Tipping at www.kofm.com.au

2. Listeners will be required to provide their name and contact details to be eligible to participate.

3. No person may register more than once to participate in KOFM’s Footy Tipping.

4. Entry is open to residents of New South Wales only, who are over 18, who comply with the entry restrictions as specified by KOFM. Directors, agents, management, employees and other staff (and their immediate family) of the Promoter or of its related bodies corporate, or of the agencies or companies associated with this competition or of any Australian Commercial Radio broadcasters may enter the competition but are not eligible to win any prizes.

5. Participants must be aged over 18 to take part in KOFM’s Footy Tipping.

6. Entries must be received by KOFM during the specified Competition Period.

7. Contest entries and material submitted in association with any contest (whether in written, print, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of competitors become the property of KOFM which may use the material in any medium (including, but not limited to; the internet) and in any reasonable manner it sees fit. Copyright in any such material becomes and remains the sole property of KOFM.

8. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, deletion, tampering, theft, destruction, transmission interruption, communications failure or otherwise. KOFM has no control over communications networks or services and accepts no responsibility for any problems or issues arising from them. KOFM is not liable for any consequences of user or network error including costs incurred.

9. Entries by e-mail are considered received at the time of receipt into KOFM’s database, not at the time of transmission by the entrant.

10. Entries will be solicited between Wednesday 10 March and Friday 16 April, however, late entries will be accepted up to a limit of 1000 active tippers.

11. Tips must be entered into the competition via the KOFM website only, no other form of footy tipping will be considered eligible.
JUDGING
• Each week, participants will be invited to provide their football tips for each game in the NRL round.
• All tips must be received 60 minutes prior to the start of the first game of the round.
• In the event that a tipper does not enter their tips for a round, they will be awarded away game scoring.
• The person judged the best Footy Tipper (based on scoring) at the end of the normal “home and away” season will be eligible to win the major prize.
• The person judged the second best will be awarded a minor prize.
In all such events, all decisions of KOFM will be final and no discussion or correspondence will be entertained.

COMPETITION
12. The competition will be conducted during the Competition Period and will follow the entry method as specified by KOFM, and to enter the competition, entrants agree that to be eligible, they must follow the entry method as specified by KOFM, during the Competition Period.

13. The competition will be drawn and/or decided at the time, on the date/s and at the location/s as specified by KOFM. The prize/s will be awarded to a valid entrant/s (as applicable) who are deemed/judged to have been the most successful “KOFM Footy Tipper”, in accordance with the details specified by KOFM regarding how the prize/s will be awarded.

14. The competition entered is a game of skill, and chance plays no part in determining the winner/s and each valid entry will be judged based on the judging criteria as specified by KOFM as part of the Footy Tipping rules. Each entry must be the entrant’s original work and the entrant must undertake to the Promoter that their entry is original, and by its use, KOFM will not be in breach of any third party intellectual property rights.

PRIZES
15. All prizes must be collected within 3-months from the date of winning. After that time, unclaimed prizes will be dealt with according to legislative requirements. KOFM will not notify winners of time remaining. It is the sole responsibility of winners to collect their prize.

16. Prizes must be claimed in person. Identification which includes a photograph will be required (examples include drivers licence, passport, student card where a photo is included). Where KOFM elects to post a prize to a winner, no responsibility will be accepted by KOFM for the safe and effective postal delivery of the prize.

17. In special situations, and subject to the absolute discretion of KOFM, a winner may nominate a designated representative to collect a prize. The representative will be required to present written authorisation from the winner and identification which includes a photograph for both the winner and their representative.

18. In the event that a winner chooses not to accept a prize, they forfeit any and all claims to that prize, which will be dealt with according to the absolute discretion of KOFM subject to legislative requirements, and no replacement prize will be offered.

19. A copy of these Terms & Conditions must be signed and endorsed by any winner upon request by KOFM to collect/redeem their prize.

20. All winners of all prizes must sign these Contest Rules and any special KOFM contest Terms and Conditions both in a form prescribed by Radio Newcastle Pty Ltd and Austereo Pty Ltd in order to receive their prize.

21. Prizes are non-transferable, must (where applicable) be used on the dates specified and are not redeemable for cash.

22. All prizes are accepted entirely at the risk of the winner and KOFM excludes all warranties in connection with any prize to the extent permitted by law.

23. KOFM, its agencies, affiliates, sponsors and representatives are not responsible for defective prizes or misuse of any prize, or for any claims, liability, loss or damage arising out of or in connection with any contest promoted by KOFM.

24. If a specified prize becomes unavailable, KOFM may substitute a replacement prize at its absolute discretion.

25. If the prize is a voucher, all vouchers are valid until the expiry date as nominated on the voucher. Redemption of the voucher is subject to the terms of service of the voucher provider and may not be varied. Vouchers cannot be redeemed for cash or for other vouchers.

26. If the prize includes tickets, all tickets are valid for the date or period as indicated on the tickets, and are subject to the terms of service of the ticket provider. KOFM will not replace lost tickets.

27. If due to any reason whatsoever, KOFM becomes aware after an entrant has won a prize that the entrant has not complied with these terms (or special Terms and Conditions), that entrant will have no entitlement to the prize, even if KOFM has announced them as a winner and that entrant will be required, at the direction of KOFM to return, refund or otherwise make restitution of the prize.

THE PRIZE(S)
Major Prize:
• The overall winner of KOFM’s Footy Tipping will win $5000 cash at the end of the NRL Football Season.
Minor Prizes:
• The person who is judged to have come last at the end of the NRL Football season will win $250 cash.
• Other prizes may be offered from time to time during the NRL Football season to the approximate value of $30 each (potentially CDs or movie tickets etc).
Total value of all prizes: $5550.
All prizes are non-transferable and consolation prizes are not redeemable for cash.
If a contestant wins the major prize in this competition, they will be ineligible to play again for a period of ninety (90) days, and will be required to sign acknowledgement of such to redeem their prize. In the event that there is a “tie” for placement, the prize will be shared equally.
All decisions and actions of KOFM shall be exercised according to the stations absolute discretion and no discussion or correspondence will be entertained.

RELEASE
28. All contestants release from, and indemnify Radio Newcastle Pty Ltd (CAN 000 225 525) and Austereo Pty Ltd (CAN 007 914 641) against all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in any contest including (but not limited to) personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.

29. Competitors may be required by KOFM to participate in a photo, video and/or film session and acknowledge that KOFM has the right to use such publicity photos/vision, video and/or film footage in any medium (inclusive of, but not limited to the internet) and in any reasonable manner it sees fit, unless that person advises KOFM at the time of entering the relevant contest that he/she wishes to retain his/her anonymity.

30. KOFM may publicise, broadcast or otherwise disclose a competitor’s name, photo, character, likeness, statements or any recording of their voice in advertising or promotional activities concerning a specific contest, or KOFM contests generally. KOFM may promote or advertise that a winner has won a contest.

31. Winners are responsible for any and all taxes payable as a result of a prize being awarded,
accepted or received.

32. KOFM may incorporate information from entrants in any contest/s in any database to be used for the purpose of its business.

GENERAL
33. A failure by KOFM to enforce any of these Contest Rules in any instance/s will not give rise to any claim by any person at the time or later date.

34. KOFM may terminate any contest at any time at its absolute discretion. In the event of such termination, KOFM may at its absolute discretion elect not to award any prize in respect of the terminated contest.

35. These Contest Rules may be changed at any time by KOFM.

36. The Promoter. The promoter of the competition is Radio Newcastle - KOFM, 252 Pacific Highway, Charlestown , NSW, 2290. The administrator of the promotion is Footy Tipping Software Pty Ltd of 10A Orrong Road, Elsternwick, Victoria, 3185, ABN 13 076 086 314.

37. Who Can Enter. Entry into the promotion is open to everybody. Directors, management, employees or immediate family of the promoter or administrator may enter the competition but are not eligible to win any of the prizes.

38. Entry Fee. There are no entry fees to register or play.

39. Promotional Material. Upon registration, participants agree to receive promotional & marketing material from the promoter.

40. Privacy Policy. All personal information collected by entering this competition will not be given/sold to any third party under any circumstances unless required by law.

41. Competition Start and Finish. The promotion commences prior to the first round of the National Rugby League Home and Away season and concludes upon the completion of the final game of the Home and Away season.

42. Entering After the Official Start Date. Participants who register after the cut-off time for Round 1 of the Home and Away Season will be awarded the default tips for the rounds they missed of Away Teams.

43. Communication during the Competition. All communication between the promoter and the participant must be via the promoter's website and electronic mail. Registration forms or weekly tips sent to the promoter via any other means of communication are void.

44. Administration of the Competition. The promoter may email the results for each round to each participant and email reminder messages to the participant to lodge tips before cut off times. The promoter will not be held responsible for any emails that are not delivered to any participant. Participant should not rely on any reminders from the promoter.

45. Tips lodgement. Tips can only be entered into the competition through the tipping competition website. The promoter takes no responsibility for your inability to access the competition website.

46. Points Allocations.
Points awarded for a Correctly Tipped win : 1 Points awarded for a Draw which was not tipped : 1
Participants can select a draw as a possible outcome. Points awarded for a Correctly Tipped Draw : 3
Maximum number of draws allowed to be tipped each round : 1
Bonus points awarded for all tipped correctly : 2
Number of Wildcards allowed during the season : 3
In a round in which a wildcard is used the score is doubled. Wildcard scores contribute to the standing in the overall competition only.

47. Weekly Cut Off Times. Tipping is closed on a Round by Round basis 60 minutes before the first game of the round. Tips entered before the deadline may be amended provided the changes are completed prior to cut-off.

48. Default Tips. Participants who fail to enter tips will be awarded the default tips of Away Teams with a default predicted winning margin of 1.

49. Dispute Resolution. In the event of a dispute, the decision of the promoter is final. No responsibility is taken for lost, or misdirected, registrations and/or weekly tips.

50. Amendment of Rules. The promoter reserves the right to amend the rules of the competition from time to time as considered necessary. Individual notice of such changes shall not be given but such changes will be recorded on the competition website.

51. Enter Only Once. Participants may not enter more than one registration. The promoter reserves the right to determine that a person has made more than one registration, and to disqualify any such person from the competition, or to delete entries so that only one entry remains.

52. Disclaimer. The promoter takes no responsibility for unauthorised access to any participant's tipping by any means, including where passwords have been revealed to third parties. The promoter will not liable for any delays or failure to perform its obligations if such a failure or delay is due to force majeure

53. Promoter’s Decision is Final. The promoter’s decision is final and no correspondence will be entered into in relation to the competition. Completion and submission of your registration is deemed acceptance of the Terms and Conditions of this competition.

54. Discretion of the Promoter. The promoter reserves the right to accept or reject any registrations, at its discretion.

55. The personal information supplied by entrants when entering this Competition will be used by the Promoter in accordance with its Privacy Policy. The Privacy Policy can be found on the Website.
56. Entrants may have their details removed from the Promoter’s database by contacting the Promoter or by sending an email to privacy@austereo.com.au. If details are removed prior to the conclusion of the Competition, publicity of the Competition and the results and/or award of prize(s), Entrants will forfeit their right to claim the Prize Package.
